Failing to take documented preventive measures against psychosocial risks (including burnout) is a breach in itself, regardless of whether a burnout has occurred or not.<\/pee>\n    <pee><strong>Application to burnout:<\/strong> An employer who has not assessed the risks of burnout in their DUERP, who has not trained their managers in prevention, and whose employee experiences burnout, is legally presumed to have failed in their safety obligation. It is up to them \u2014 and not the employee \u2014 to prove that they took all necessary and proportionate measures.<\/pee>\n<\/div>\n<h3>1.1 The three levels of employer responsibility<\/h3>\n<pee>The employer&#8217;s safety obligation regarding burnout operates on three levels that can be engaged simultaneously or successively.<\/pee>\n<div class=\"acteur-grid\">\n<div class=\"acteur-card\">\n<div class=\"a-icon\">\u2696\ufe0f<\/div>\n<h5>Civil liability<\/h5>\n<pee>Engagement before the Labor Court by the employee or their beneficiaries.
