You can ask for an assessment yourself, and the local authority must give you a decision within set timescales. This guide covers England only; Scotland, Wales and Northern Ireland work differently.</pee>

Key points

An EHCP is a legally binding plan for children and young people aged 0 to 25 whose needs cannot be met through the support a school or college normally provides.

Parents can request an EHC needs assessment directly from the local authority. You do not need the school’s permission or a diagnosis.

The local authority has 6 weeks to decide whether to assess, and the whole process should take no more than 20 weeks in most cases.

If the answer is no, you have a right of appeal to the First-tier Tribunal (SEND), and free independent advice is available.

This article applies to England. Scotland, Wales and Northern Ireland have their own systems.

What is an EHCP?

<pee>An EHCP is a plan that describes a child’s or young person’s special educational needs, the outcomes they are working towards, and the specific help they must receive to get there. It was introduced by the Children and Families Act 2014 and works alongside the SEND Code of Practice, the statutory guidance that local authorities, schools and health bodies must have regard to.</pee>
<pee>The key word is “legal”. Unlike a school’s internal support plan, the education provision written into an EHCP is something the local authority has a duty to arrange. If the plan says your child needs a set amount of specialist teaching, speech and language therapy or classroom assistance, that is not a suggestion.</pee>
<pee>The plan is also joined up: education, health and social care are described in one document.</pee>

Who is an EHCP for?

<pee>An EHCP is for children and young people from birth to 25 who have special educational needs that cannot reasonably be met from the resources normally available to their school, nursery or college.</pee>
<pee>The needs involved vary widely. They may relate to autism, ADHD, dyslexia and other specific learning difficulties, speech, language and communication needs, a learning disability, sensory impairments, physical disabilities, or mental health difficulties that affect learning. The label matters less than the effect: what does your child need in order to access education, and is that more than a mainstream setting can ordinarily offer?</pee>
<pee>It is worth stressing that you do not need a diagnosis. Evidence from teachers, health professionals and you as a parent counts, and a diagnosis does not guarantee a plan on its own.</pee>

How is an EHCP different from SEN support?

<pee>Most children with special educational needs in England do not have an EHCP. They receive “SEN support” from their school, usually organised by the Special Educational Needs Co-ordinator (SENCo), and funded from the school’s own budget. The school follows a cycle of assessing, planning, doing and reviewing.</pee>

SEN support

EHCP

Who arranges it

The school or nursery

The local authority, with schools and health services

Legal status

Schools must identify and meet needs, but there is no individual legal document

Legally binding plan; provision must be secured

Scope

Education support

Education, health and social care

Review

Regular review by the school

Formal review at least every 12 months

Right of appeal

Complaints route only

Appeal to the First-tier Tribunal (SEND)

<pee>Good to know: you do not have to “try SEN support first” before asking for an EHC needs assessment. Evidence of what the school has already tried will strengthen your request, but a local authority cannot lawfully insist on a fixed period of SEN support before it will consider you.</pee>

How do you request an EHC needs assessment?

<pee>The first formal step is asking the local authority for an EHC needs assessment. This is the investigation that may lead to a plan; it is not the plan itself. Parents, young people aged 16 to 25, and schools or colleges can all make the request. As a parent you can write directly to the SEND team of the local authority where you live.</pee>

Find your local authority’s process. Most councils publish a form on their “Local Offer” webpages, but a clear letter or email is also valid. You do not have to use their form.

Explain your child’s needs. Describe what your child finds hard, what support is already in place, and why you think it is not enough.

Attach evidence. Useful items include school reports, SEN support plans, reports from educational psychologists, speech and language therapists, paediatricians or occupational therapists, and your own diary of difficulties at home and school.

Keep proof of sending. Date your request, and keep a copy. The statutory clock starts when the local authority receives it.

<pee>It is sensible to tell the school you are making the request. If the school is reluctant, you can still go ahead on your own.</pee>

What are the timescales, and what happens during the assessment?

<pee>England’s EHCP process runs to a statutory timetable, counted from the date the local authority receives your request. The headline limits are below. There are limited exceptions, for example where a child is absent for an extended period or exceptional personal circumstances arise, so check the SEND Code of Practice if your case seems to be running late.</pee>

Within 6 weeks: the local authority decides whether to carry out an EHC needs assessment and tells you its decision.

Within 16 weeks: if it assesses, it decides whether to issue an EHCP and tells you.

Within 20 weeks: the final EHCP should be issued, if one is to be made.

<pee>Once a draft plan is sent to you, you have 15 calendar days to comment, ask for changes and state which school or setting you would prefer.</pee>

What happens during the assessment?

<pee>If the local authority agrees to assess, it must gather advice from several sources. These include you and your child, the school or early years setting, an educational psychologist, health professionals who know your child, and social care where relevant. You should be invited to contribute and to share your own views about what works and what does not.</pee>
<pee>Take the opportunity seriously. This is the evidence on which the plan, if there is one, will be written. Be specific. “He struggles to sit still” is less useful than describing what happens during a lesson, how long he can concentrate, what helps, and what the consequences are afterwards.</pee>
<pee>Not every assessment ends in a plan. After gathering the evidence, the local authority decides whether the child’s needs justify an EHCP. If it decides they do not, it must tell you its reasons in writing.</pee>

What does an EHCP contain, and can you choose the school?

<pee>An EHCP is organised in lettered sections. The ones parents most often focus on are these:</pee>

Section A: your views, wishes and aspirations, and those of your child.

Section B: the child’s special educational needs.

Section F: the special educational provision required. This is the heart of the plan and needs to be specific and quantified.

Section I: the name and type of school or other setting.

<pee>The remaining sections cover health needs and provision, social care needs and provision, outcomes, and any personal budget. Vague wording in Section F is a common problem. “Access to support as needed” is hard to enforce; “20 minutes of one-to-one phonics teaching three times a week” is not.</pee>

Can you choose the school?

<pee>You have the right to request a particular school, college or other setting for Section I of the plan. Local authorities must consider your preference and name it unless the placement would be unsuitable for the child, or would harm the efficient education of others or the efficient use of resources. In practice, this is one of the most disputed parts of the process, so give reasons for your choice and visit the schools you are considering if you can.</pee>
<pee>A plan can also name a mainstream school with additional support, a special school, a specialist resourced provision, or a further education college for older students.</pee>

What if the local authority refuses?

<pee>Refusal is not the end. You can challenge three main decisions: a refusal to carry out an EHC needs assessment, a refusal to issue a plan after assessing, and the content of a plan, including the description of needs, the provision, or the school named.</pee>

Ask for the reasons in writing. The local authority must explain its decision and tell you about your right of appeal.

Contact a mediation adviser. Before you can go to the tribunal you must obtain a mediation certificate, but you do not have to take part in mediation if you do not wish to.

Appeal to the First-tier Tribunal (Special Educational Needs and Disability). The usual deadline is two months from the date of the decision letter, or one month from the date of the mediation certificate, whichever is later. There is no fee to appeal.

Consider a fresh request. If your child’s situation has changed or you now have stronger evidence, you can ask again.

<pee>Where to get free help: every local authority area has a SEND Information, Advice and Support Service (SENDIASS) that is independent of the council. Charities such as IPSEA also provide legal information and guidance to families. Contact them early, as they can help you read the draft plan before you reply.</pee>

What happens once you have an EHCP?

<pee>The local authority must review the plan at least once every 12 months, and the review should involve you, your child and the professionals working with them. From Year 9, reviews should begin to include preparation for adulthood, covering further study, employment, independent living and health. If you disagree with the outcome of a review, you may have further appeal rights.</pee>
<pee>A plan can continue until 25 if the young person remains in education or training and still needs it. It will end if the local authority decides it is no longer necessary, and that decision can itself be challenged.</pee>
<pee>You may also be offered a personal budget, which can give you some choice over how part of the funding for your child’s support is used. Not every family will wish to take this up, and it does not remove the underlying duty to provide the support in the plan.</pee>

Do Scotland, Wales and Northern Ireland have EHCPs?

<pee>No. EHCPs belong to the English system. Education is a devolved matter, and each of the other UK nations has its own laws, terms and processes.</pee>

Scotland: support is organised under the “additional support for learning” framework. Some children receive a Co-ordinated Support Plan, which is a different legal document with different criteria.

Wales: the Additional Learning Needs and Education Tribunal (Wales) Act 2018 replaced statements and similar plans with an Individual Development Plan (IDP).

Northern Ireland: support is arranged through a staged process and, for some children, a statement of special educational needs. The system has been under reform, so check current guidance from the Education Authority.

<pee>If you live in or are moving between nations, contact the relevant local education body and ask what applies to you. A plan from one nation does not automatically transfer to another.</pee>

How can you support your child while you wait?

<pee>The assessment process can take months, so talk to the SENCo about what can be put in place now, and keep a diary of difficulties and what helps, as this feeds directly into the evidence. The following activities and games build skills and confidence in the meantime. None of them replaces an EHCP, an assessment or professional advice.</pee>

COCO THINKS and COCO MOVES: playful educational games for children that exercise attention, memory and reasoning, and encourage movement.
