These Terms of Use and Sale (hereinafter the "Terms") govern access to and use of the Coach Assist AI service published by DYNSEO, as well as the subscription to plans and the purchase of associated message packs. By activating Coach Assist AI on any of our brain-coach apps, you accept these Terms in full.

Article 1 — Service Publisher
The Coach Assist AI service is published by DYNSEO, a French company headquartered at:

DYNSEO is a French company, Qualiopi-certified, specialized in designing cognitive stimulation programs and brain training for all ages, available in over 8 languages worldwide.
Article 2 — Definitions
- "Service" means the Coach Assist AI, the intelligent voice coach integrated into DYNSEO's brain-coach applications.
- "User" means any natural or legal person using the Service, whether a player, a caregiver, a parent, a professional, or an institution.
- "Player" means the person assisted by the Coach Assist AI (child, adult, or senior).
- "Application" means any of DYNSEO's brain-coach applications listed in Article 4.
- "AI Message" means a voice interaction between the Player and the Coach Assist AI, comprising one request and one response.
- "Subscription" means the monthly, quarterly, or annual plan including Coach Assist AI access.
- "Pack" means a one-time purchase of additional AI Messages.
Article 3 — Service Description
Coach Assist AI is an intelligent voice companion that:
- Interacts with the Player in real time through natural voice conversation
- Automatically launches games and exercises tailored to the Player's profile
- Personalizes each session based on the Player's nickname and favorite games
- Encourages, congratulates, and offers progressive hints
- Remains available 24/7 as soon as the application is opened
- Speaks the local language of each cultural version
⚠️ Important: Coach Assist AI is a cognitive support and stimulation tool. It does not replace any healthcare professional, speech therapist, physician, special educator, or any other form of human accompaniment. It complements, but never replaces, professional care.
Article 4 — Available Brain Coaches
Coach Assist AI is integrated into DYNSEO's full ecosystem of culturally adapted brain coaches. Each coach speaks the local language and offers content tailored to its target audience and culture:
The Coach Assist AI feature operates identically across all coaches: same architecture, same privacy guarantees, same on-device processing — only the language, voice, and cultural references change.
Article 5 — Access and Activation
5.1 Availability
Coach Assist AI is currently available in beta on iOS (iPhone and iPad). The Android version is in development and will be announced soon. The feature is gradually rolling out across all coaches listed in Article 4.
5.2 Internet Connection Required
An internet connection (Wi-Fi or 4G/5G) is required for real-time voice exchanges. The Service does not work offline.
5.3 Activation
Coach Assist AI is activated from within any eligible DYNSEO application after subscription to a qualifying plan or purchase of a message pack.
Article 6 — Subscriptions and Message Packs
6.1 Application Subscriptions

Prices may be displayed in local currency on the App Store and Google Play according to regional pricing rules.
6.2 Additional Message Packs
Packs are one-time purchases, with no subscription, usable across all DYNSEO brain coaches:

6.3 Renewal and Consumption
- Subscriptions renew automatically at term, unless cancelled in advance.
- AI messages included in a subscription renew monthly and do not roll over from one month to the next.
- Packs are consumable: once messages are used, the User may purchase a new pack at any time.
- Once the monthly quota or pack is depleted, the games remain fully accessible — only Coach Assist AI is temporarily disabled until top-up.
Article 7 — Payment Terms
Payments are secure and processed by official platforms (App Store, Google Play) or by our certified payment provider. Prices are shown in euros, including VAT where applicable. DYNSEO reserves the right to change pricing at any time; new prices apply to new subscriptions and renewals only, with no retroactive effect on active subscriptions.
Article 8 — Right of Withdrawal
In accordance with EU consumer law (Directive 2011/83/EU) and Article L.221-28 of the French Consumer Code, the User acknowledges that by immediately activating Coach Assist AI upon subscription, they expressly waive their 14-day right of withdrawal for digital content supplied without a tangible medium and whose performance has begun with their explicit consent.
The User may nevertheless cancel their subscription at any time from within the application, free of charge, with cancellation taking effect at the end of the current billing period.
Article 9 — Privacy and Data Protection
🛡️ Our core commitment
No conversation between the Player and Coach Assist AI is sent, stored, or kept on DYNSEO's servers. Everything stays on the User's device. This is a foundational commitment of our architecture, applied identically across every coach (COCO, SCARLETT, CLINT, SOFIA, ROBERTO, CARMEN, FERNANDO, ANNELIES, ZHIQU, IQU and any future coach).
9.1 Locally Processed Data Only
Coach Assist AI runs on a 100% local conversation architecture. This means:
- No voice recording is transmitted to our servers
- No text transcription of exchanges is kept by DYNSEO
- No content analysis of conversations is performed by DYNSEO
- No profiling based on conversations is carried out
9.2 Automatic Deletion at Each Session
Each voice session is independent and ephemeral:
- When the application is closed, the conversation is automatically deleted
- The next time the app opens, Coach Assist AI starts a fresh conversation, with no memory of past exchanges
- No trace of the conversation is synchronized or saved
9.3 Minimal Data Used by the Coach
To personalize the exchange, Coach Assist AI accesses only:
- The Player's nickname or first name (entered when the profile is created)
- The Player's list of favorite games
These two pieces of information are the sole basis for personalization and remain stored locally on the device. No other personal data (address, health status, medical history, etc.) is used by the Coach.
Article 10 — On-Device Processing and Session Lifecycle
The lifecycle of a conversation strictly follows these steps:
- Application opens: The Coach launches and accesses the nickname and favorite games (local data only)
- Voice session: Real-time exchanges happen on the device
- Application closes: The conversation is automatically erased — no trace kept
- Next session: The Coach starts from scratch, with no memory of previous sessions
💡 Why this architecture? Because Coach Assist AI users are often vulnerable populations (children, seniors, people with disabilities). We believe no conversation, even anonymized, should leave the User's device. This is a strong ethical choice, anchored in our identity as a French company committed to user trust across all markets we serve.
Article 11 — GDPR Compliance
DYNSEO, as a French company, strictly applies the General Data Protection Regulation (GDPR — EU Regulation 2016/679) as well as the French Data Protection Act. Our data processing has been declared to the French Data Protection Authority (CNIL) since June 11, 2013, under registration number 1679021.
11.1 Data Collected by DYNSEO (excluding conversations)
For account and subscription management, DYNSEO collects:
- Email address (account creation, service communications)
- Account holder's first and last name (billing)
- Payment data (handled by our payment provider, never stored by DYNSEO)
- Minimal technical data (device type, OS version) for proper operation
11.2 Beta Phase Note
During the Coach Assist AI beta testing phase only, anonymized usage logs may be collected to improve the system (activation events, error logs, response time metrics). No conversation content is included in these logs. By participating in the beta program, you consent to this temporary log collection. You may withdraw from the beta program at any time by contacting us. Once Coach Assist AI exits beta, only the standard local processing described above will apply.
11.3 Your Rights
Under GDPR, you have the following rights:
- Right of access to your personal data
- Right to rectification
- Right to erasure ("right to be forgotten")
- Right to restrict processing
- Right to data portability
- Right to object to processing
- Right to withdraw consent at any time

11.4 Hosting
Account management technical data is hosted on French servers (OVH) within the European Union. DYNSEO does not transfer your personal data outside the EU without appropriate safeguards (Standard Contractual Clauses, adequacy decisions). During the beta phase, certain AI processing components may involve data transfers outside the EU to our AI service providers, with appropriate safeguards in place.
11.5 Complaints
You have the right to lodge a complaint with the CNIL (www.cnil.fr) or with your local data protection authority if you believe your rights are not being respected.
Article 12 — User Obligations
The User agrees to:
- Use the Service in accordance with its purpose (cognitive stimulation, playful accompaniment)
- Not attempt to circumvent the AI message limits
- Not use the Service for unlawful, fraudulent, or harmful purposes
- Not attempt to reverse-engineer the Service or extract the underlying AI model
- Supervise, as a parent or caregiver, the use of the Service by minors or vulnerable persons
- Not share their access credentials
Article 13 — Service Limitations
13.1 Beta Status
Coach Assist AI is currently in beta. Updates, fixes, and improvements are deployed regularly. Temporary service interruptions may occur.
13.2 Functional Limitations
- The Coach is not a healthcare professional: it does not diagnose, prescribe, or replace a doctor, speech therapist, or therapist
- The Coach may make errors or imperfect rephrasings — it is a generative AI tool and not a medical authority
- In a medical or psychological emergency, contact emergency services immediately or a qualified professional
Article 14 — Liability
DYNSEO uses all reasonable means to ensure the availability, quality, and security of the Service. However, DYNSEO's liability cannot be engaged:
- For interruptions due to network outages, maintenance, or force majeure
- For non-compliant use of the Service by the User
- For indirect damages (loss of opportunity, abstract moral prejudice, etc.)
- For consequences of decisions made by the User based solely on Coach interactions
DYNSEO's total liability, all causes combined, is limited to the amount paid by the User over the previous 12 months.
Article 15 — Intellectual Property
All elements of the Service (code, design, content, brands COCO, SCARLETT, CLINT, SOFIA, ROBERTO, CARMEN, FERNANDO, ANNELIES, ZHIQU, IQU, JOE, EDITH, DYNSEO, logos, synthetic voices, Coach phrasings, cultural adaptations) are the exclusive property of DYNSEO or its partners. Any reproduction, representation, modification, or exploitation, in whole or in part, without prior written authorization is strictly prohibited and constitutes infringement under the French Intellectual Property Code and applicable international IP laws.
Article 16 — Suspension and Termination
16.1 By the User
The User may cancel their subscription at any time from the application settings or from the subscription platform (App Store, Google Play). Cancellation takes effect at the end of the current period.
16.2 By DYNSEO
DYNSEO reserves the right to suspend or terminate access to the Service in case of:
- Non-payment
- Violation of these Terms
- Fraudulent or abusive use of the Service
- Decision to discontinue the Service (with reasonable notice and pro-rata refund)
Article 17 — Modification of the Terms
DYNSEO reserves the right to modify these Terms at any time. Users will be notified of any substantial change by email or in-app notification at least 30 days before the new terms take effect. Continued use of the Service after that date constitutes acceptance of the new terms.
Article 18 — Mediation and Amicable Resolution
In the event of a dispute, the User is invited to first contact our customer service at contact@dynseo.com to seek an amicable resolution. Failing agreement, consumer Users may turn free of charge to the competent consumer mediator or to the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.
Article 19 — Governing Law and Jurisdiction
These Terms are governed by French law. Any dispute relating to their interpretation or performance shall, failing amicable resolution, be submitted to the competent courts of Paris, subject to mandatory consumer protection rules applicable in the User's country of residence.
